  • Advice on the statutory framework under the Owners Corporations Act 2006 and Subdivision Act 1988 and regulations under those Acts;
  • Advising as to the Short Stay Levy Act 2024 and the Company Titles (Home Units) Act 2013
  • Contracts for the sale of part of common property affected by an Owners Corporation;
  • Drawing Owners Corporation Certificates for newly created Owners Corporations;
  • Drawing rules of Owners Corporations and arranging recording of those rules;
  • Preparing proposed special and unanimous resolutions of members;
  • Preparing leases and licences of common property and transfer documents;
  • Preparing pro-forma documents for Owners Corporations;
  • Attending internal dispute resolution meetings.

Title Conversion:

  • Converting Company Share properties to a subdivision with an Owners Corporation;
  • Conversion of Stratum title properties to a subdivision with an Owners Corporation;
  • Applications to remove common property and Owners Corporations from subdivisions;
  • Changing plans of subdivision: including common property in lots amongst others

Conveyancing:

  • Acting for vendor and purchaser on Contracts for the Sale of Real Estate: Residential, Commercial, Retail and Industrial properties.

Title related matters:

  • Converting General Law land (old law deeds title) to the Torrens System (registration system of title);
  • Transferring title to another party, transfer of title between spouses/partners;
  • Application for title by adverse possession;
  • Advising on the location of lot title boundaries in owners corporation developments;
  • Advising on rights and responsibilities of parties concerning easements.

Wills, Probate, Estate Administration, Powers of Attorney

  • Drafting of Wills and Powers of Attorney;
  • Making application for Grant of Probate/Letters of Administration;
  • Advising executors of deceased estates of requirements and procedures under the Administration and Probate Act 1958;
  • Estate administration including the sale, transfer and distribution of estate assets;

Property Litigation:

  • Victorian Civil and Administrative Tribunal (including Owners Corporations matters, Water Act claims and applications in the Civil and Real Property Lists).
